Yes, with a green card, not with citizenship. But because of the limited number of visas each year, it may take years, depending on the employee's qualifications, current legal status in the U.S., etc.

Yes, but it will depend upon the situation. If the employee has entered without authorization or does not have legal status, there is often very little to be done. If an employer is interested in an individual that does currently have legal immigration status there are typically more options availble.
