Legal Question in Immigration Law in California
Immigration appeals hell
My husband is an Italian citizen, and I am trying the get him legally into the
country. We have been married for four years, so this is legit. He is a skilled
craftsman, but he has a small blip on his criminal record from 11 years ago. His
case is currently in the appeals process, I need to know what to do now.
I am currently involved with a semi-serious medical condition, his income and
emotional support is desperately needed. If his appeal is denied, what do I do
then. Was it a mistake to try to get him legal status with out him being in the
the country.
Thanks for your help

Re: Immigration appeals hell
The first question is what was he convicted of? If it was a crime of moral turpitude or an aggravated felony (Federal Immigration Definitions) then this is more serious than if it was not.
Often mistakes are made by the Immigration Service when they try to understand a state criminal conviction, and wrongly deny people entry into the United States, or deport them after they serve their criminal sentence, and often times there is no reason to do this.
The difference between success and failure in either gaining entry into the United States or preventing deportation from the United States after a tangle with the criminal justice system is often having a good, aggressive, and experienced Immigration Deportation Attorney on your side.
Please call our office immediately to speak with one of our seasoned, tough, and experienced Deportation Defense Attorneys in order to see if there is something we can do for you and your husband.

Please note that since your husband is married to an US citizen he is eligible for certain waivers. I need to know more about his criminal records. Was he deported for commiting the crime?
