Legal Question in Immigration Law in California

Immigration and divorce

I've been married 9 years. my husband is a legal resident and petitioned me in 1997. I now have a work permit which Iattained thru the v visa and work as a registered nurse. If we divorse would I loose the opportunity to become a resident of the U.S.? or would my carrer and the years that I've been in this country (since 1988) help me in the process of obtaining the permanent residency?

Re: Immigration and divorce

Let me give you a straight answer instead of mumbo-jumbo. If you divorce before you receive the permanent residency stamp at the final interview with the BCIS (INS), you're going to lose everything. Your length of time and job in this country will not help you one bit except maybe in deportation proceedings in front of a judge. If you're going to divorce, do it after your case is approved.

Re: Immigration and divorce

the length of your marriage and employment as a nurse in the US will certainly be strong considerations in granting your permanent residency. please email more specific details of your case, i.e. your national origin, if your husband is a US citizen or just a legal resident, etc...and i may be able to further assist you.

Since you have waited more than 2 years...your greencard will not be conditional...your divorce will not effect your permanet residency. Take a look at my site at www.lawyers.com/amyghosh
