Legal Question in Immigration Law in California

Immigration Law & Marriage

4 years ago I married a man from Mexico who entered without authorization - EWA - came across the border without permission. He EWA's in 1999. We were married in 2003. He just wants a social security card so he can pay into a legal account, and the ability to work and drive. He is not interested in becoming a citizen but does want to have legitimate papers. Does our marriage help him at all? What can we do to get official papers? I am at a loss. HELP!

If you are a citizen or a resident you will be able to petition for your husband. Most likely he will have to apply for a waiver of his unlawful presence and return to Mexico to obtain his residency. I recommend contacting an immigration lawyer to assist with the process.

You can apply for him, since he EWI he needs to go back to Mexico for his final interview and apply for the waiver at that time.
