Legal Question in Immigration Law in California

Immigration - live and work in the US

Hello,

I'm a Belgian citizen in a relationship with an US citizen. What is my best course of action to be able to come live with him and find work ?

Thank you.

Marriage to a US citizen would allow you to apply for permanent residence in the U.S.

A K-3 spouse visa allows you to enter the U.S. officially as the spouse of a US citizen.

After entering the U.S., you may apply for your permanent residence through the adjustment of status process.

Re: Immigration - live and work in the US

if you are still in Belgium, we can always file what is called a fiance case. Or, if you two are already married we can file a petition for Permanent Residence. the case usually takes between 6-8 months. Feel free to contact my office for an appointment. the initial consultation fee is just $80. We are based in the San Francisco Bay Area.

You could have a variety of options depending on your employment history and employment opportunities in the U.S. You also might be able to petition for yourself, again, based on your background. Finally, if you plan on marrying, then you could possibly qualify as a fiancee or spouse of a U.S. citizen.

In addition to the manner of qualifying, the procedure embarked on can also involve options, with some being less time consuming and keeping you and your US person together as much as possible.

As the other attorneys said a fiancee visa would work, and you should get an attorney. If you are located in Orange, San Diego or Imperial Counties, you can email me your contact info, so we can discuss your particular situation. There is no charge for consultation.

Re: Immigration - live and work in the US

If you are outside the U.S. your U.S. citizen fiance may file a fiance visa petition on your behalf. Once you arrive in the U.S., you would need to marry within 90 days and subsequently file for your green card. You would be work authorized upon entry into the U.S. with your fiance visa.
