Immigration Problem

Last February 2009 I got married to a US citizen, I entered here with a tourist visa, last October 2008. My I-130 is already approve, suddenly my wife doesn't want to continue my petition because she suddenly want a divorce, because she realize that, she is still young and she don't want to be tied up and the second reason why she want's to end our marriage because we found out last month that i have a health problem. And there's one time I want to go to there house to fix our problem, she just tell me that ''don't go to our house our else my family will gonna bit you up'' Please help regarding my status now. Can file for VAWA? I don't have any evidence, to backup VAWA because all the things she said to me is by phone call or verbally.

VAWA is available for people who have been subjected to physical abuse or extreme emental cruelty by their US citizen spouse. If you believe that your wife has treated you with extreme mental creulty, you may be eligible for VAWA relief.

I am sorry to hear that you are going through a troubling time.

Even though you may not have current concrete evidence to show that you suffered abuse, there may be other ways to provide evidence, such as affidavits and professional psychological reports to show your emotional hardship in order to qualify for VAWA.

If you can show that the marriage is real and that you suffered abuse, whether verbal, physical and/or emotional abuse at the hands of a US citizen or Legal Permanent Resident spouse, you may have a case for VAWA.

In the alternative, if a divorce is finalized, there may be way for you to self-petition.
