Legal Question in Immigration Law in California

interview process for greencard through marriage

I applied for I-130 for my husband, and waiting to hear from them. I am an US citizen, but currently I am unemployed, and I have around $18,000 for the past 3 years. My father who is also an US citizen applied as a joint sponsor. I was just wondering what is the process after we applied and what questions are they going to ask during the interview. Is my not having a job be a problem for my husband getting a visa?

Re: interview process for greencard through marriage

Your unemployment will not be a problem if your father's income as a joint sponsor push the total income to the required minimum level for your family's size. The interview will consists mainly of the officer asking you two questions to make sure you have a real marriage, and to make sure your husband does not have inadmissible grounds such as criminal problems, child support, or other issues. I recommend you both memorize important dates so you know them cold, such as birthdates, marriage date, his entry date, etc. If you relax, the interview will go much more smoothly. Some couples choose to hire an attorney to go with and represent them at the interview but that's your choice.

You and your father should go to the interview, but this matter is complex and you should get an attorney. If you are located in Southern California, you can email me your contact info, so we can discuss your particular situation. There is no charge for consultation.

It is not a problem that you don't have a job and you can have your father as a co-sponsor. At the interview, the officer will go over the questions on the applications and will make sure that your marriage is in good faith.
