investors and immigrant who marry u.s. citizens
1. what provision of INA governs foreign investors who would like to immigrate by investing?
2. can an immigrant spouse who marries a u.s. citizen leave the country while she is applying for adjustment of status? what if her visa expires while she is out of country, can she get back in with her u.s. spouse by showing proof of marriage and copy of adjustment of status application?

1. INA Sec. 203(b)(5), 8 USC 1153(b)(5); 8 CFR 204.6 You should also look at provisions for Multinational Executives and E treaty trader visas.
2. She cannot leave without getting special permission first (advanced parole) from the INS
