Legal Question in Immigration Law in California

Can two Italian citizens (one American resident and one with a I Visa) open a DBA in California? Can they be linked by a General partnership agreement?

Hello:

They can open a business. The real question is whether the one with the I visa has the authorization from immigration to do this - which he does not. He needs to get an E-2 .
