Legal Question in Immigration Law in California

Keeping permanent residence

Ive been permanent resident of the USA since September 2001. I lost my husband who was American citizen due to cancer in September 2004.We have been married for 8 ys. I was denied citizenship after three years, because my husband was not alive at the time of my interview with INS.

Since I have no family here and I have minor children I would like live a country to have help and support of my family in this time of need for my children. Id like to stay abroad 1-3 ys. How can I preserve my permanent residency and keep my green card? Is there a chance at all to keep my residence while living abroad for a while?

Re: Keeping permanent residence

Staying outside of US for more than 1 year would be a big risk of losing your permanent residence. Please seek formal attorney's help before you leave the country.

Re: Keeping permanent residence

you can apply for a Re-Entry Permit which will allow you to stay abroad for up to two years without losing your Permanent Residence Status.
