Legal Question in Immigration Law in California

Legal Resident Neets Re-Entry Visa

My fiancee is lawfully in the U.S. and has a permanent resident ''Green card''. We are getting married in May 2004 and plan to leave the country on our honeymoon. I am born here and a U.S. citizen. What is the best way to obtain a re-entry permit for her so we can go on our honeymoon?

Thanks for your help.

I am assuming that she does not have a green card...if she has independent legal status..such as H1B/F1..it will be easier for her to comeback from honeymoon...then apply for adjustment of status.

If she is a permanent resident of the US, she does not need a re-entry visa.

Re: Legal Resident Neets Re-Entry Visa

Thank you for your inquiry. If your fiancee is in possession of a green card she can travel freely in and out of the US using the same and will not need to obtain a re-entry permit unless she will not re-enter the US for one year or longer.

If her permanent residency petition is still pending she will need to obtain advanced parole so that she can re-enter.
