How long does it take to get a Labor Certificate

I wonder how long does it take to get a Labor Certificate for an H1B visa. I heard that it takes about a year. Another thing: how long does the employer have to have an ad for the available position and what are the regulations for this ad.

I think you are confusing the labor certification ("greencard" process) with the labor condition application (which applies to the H-1B petition).

The latter process takes not more than 7 business days for certification.

While you are in H1B you can apply for Labor certification..and these days...it takes close to a year and a half at least for labor certification process. If you want to file under RIR it is faster but you need to show recruitment efforts in the last six months. Also...there is a possibility of current labor certification process getting eliminated if the PERM regulation becomes effective. Please take a look at my site at www.lawyers.com/amyghosh
