Legal Question in Immigration Law in California

Lost I-94

My fiancee finally decided to go home to her country next week. She is ''out of status'' for 9 months. We know the consequence and we are willing to accept it. Our problem is she ''LOST'' her I-94 and she is planning to leave next week. (no more time to get a new one. I'm on waiting for my AOS.

Can she go home without I-94?

What's the process of going back home (LAX airport)?

How will they know that she overstayed? (just curious)

Is this a best decesion?

Re: Lost I-94

Going home is the easy part. They don't care if she's out of status as long as she's leaving the US.

Going back is hard. If she wants to come back eventually on a different visa, she might have a small problem documenting to the US consulate her authorized period of stay in the US without the I-94. With other evidence she'll be able to show she was 9 months out-of-status. But you said you've accepted the consequence: she'll be barred from re-entering the US for 3 years.
