Legal Question in Immigration Law in California
A man is working here on a temporary Visa that expires in 2014. If he is declared the father of a child by a state court, would that allow him to change to a resident alien, or some other status, to prevent being deported in 2014. Thank you!

No. A U.S. citizen child cannot petition a parent until they are 21 years old. The father will need to maintain his valid non-immigrant visa status or return home.
