Legal Question in Immigration Law in California

Marige in US or outside US?

I have fianc who is Croatian citizen same as I. Im US resident and can apply for citizenship in about two years. I wont to live with her here. What is the best way to do it. Should we get married here in US or in Croatia? And should I wait to get citizenship or can we get married now. Thank you in advance!

Obtaining US citizenship first then filing for her permanent residence would be the fastest way for her to obtain lawful permanent residency through marriage to you.

I would most likely advise you to get your US citizenship, and then apply for K-1 Marriage Visa. But some attorneys would disagree.

Re: Marige in US or outside US?

Be careful between now and when you become a U.S. citizen. By the time you are able to bring her, it will be several years. If you marry before you petition for her as a citizen (whether by fiance or spouse), it will be much harder to get a nonimmigrant status in a separate category after the marriage. To unite sooner, she might qualify for a different status having nothing to do with your marriage. If she does, she will be able to join you much sooner. Please contact me offline so I can learn more about her and determine for you whether she qualifies for a status to tide her over.

If you don't carefully plan this, you will be separated for a long, long time and she might have trouble even traveling here.
