Legal Question in Immigration Law in California

second marriage

I divorced american citizen after 1 year and 2 months of marriage for abusing reasons. I applied for my green card again (form I-360) after I divorced him . The USCIS have had my petition since april 1st 2005, I am still waiting for decision from them. I have been in the new relationship and we are very happy and it has been a year since my divorce. we just got engaged and my question is, Could I get married or are there any rules that immigration has to stop me from marring my fiance?

Thank you!
