Legal Question in Immigration Law in California

Marriage with an illegal alien, sort of....

I am a divorced father of 2 who met a wonderful person which made me rethink marriage. The problem was that she entered the country illegally throulgh Canada. So, to make things right, I took her back to Korea last September and got an OK from their parents for marriage. We then filed for I-129f and subsequently K-1. My fiance just came out of the interview and was denied visa because immigration found out about her illegal stay in the US.

I am devastated...We've been separated for 6 months and that was extremely hard already but now this...

1) Is there any way we can still get married and live in the US?

2) Would immigration consider this a fraudulent marriage and prosecute me for trying to marry a former illegal alien?

I am truly and utterly devastated...any words of advice would greatly be appreciated. Thanks.

I am sure you did not consult with an attorney. the proper thing to do was get married , sponsor her and at the time of appearing at the consulate present a waiver for her illegal stay. If you do not follow the proper procedure ofcourse the case would be denied. Marrying an illegal alien is not a crime. She is very much eligible for waiver and grrencard!!!!!
