Legal Question in Immigration Law in California

Married an illegal alien

My wife of 2-yrs came into the U.S. illegally when she was 7-yrs of age. We have 2 daughters togehter and she has 1 son all are U.S. citizens. Her mom was deported in 2006 which left us caring for 4 of her brothers all U.S. citizens unders the age of 18. I would like to file a petition for her the only thing that is stopping me is that she might have to go back to mexico. It would be very hard to care for 8 kids and work at the same time. What might be the chance that she qualifys for ''cancellation of removal''? What else can we do? Thank you for your time.

You'll want to file for her permanent residence. Then she'll have to consular process and submit a waiver application for adjudication.

Most well-prepared waivers are approved at Ciudad Juarez in Mexico although I recommend you get an attorney to assist you with this process.
