Legal Question in Immigration Law in California

Married to people with I485 status

Hi there,

I just received the I-797C Notice of Action form for the approval of I485 and need to go to the INS office for fingerprinting for the I-89 form. I am just wondering if I can quickly get marry with my fiance' (currently with H-1 working visa) and add her name to the application. What is the best way of handling this situation? If I received my green card and then get marry, how long will it take for my wife to get the green card?

Thanks ahead for all your help.

Vince

Re: Married to people with I485 status

you were supposed to get married prior to being approved for Permanent Residence. Now she'll just be the spouse of a Permanent Resident. It will be more than 5 years before she is eligible for LPR status with you as sponsor. Big mistake.

Your wife would need to submit her own application for lawful permanent residence. The adjudication timeline depends on where you can file the application.
