Re: marriege laws

You have to pay a fine of $1000 and if you are under 245 (i) you would be able to adjust in the United States.

Re: marriege laws

you may not even need 245(i). it will depend on how you entered the country. feel free to contact my office for an appointment, and we'll see what can be done. the initial consultation fee is just $80.

Re: marriege laws

If the person entered legally into the U.S. then you can apply from the U.S. If s/he entered illegally or are otherwise ineligible to "adjust status" (apply) in the U.S. but filed certain papers before April 1, 2001, then you can still apply from here in the U.S. and are eligible to adjust status. Cases like that are 245i eligible, i.e., the person can adjust status in the U.S. even if they usually wouldn't qualify. If neither of these situations exist, then the person needs to visa process. The visa abroad could be denied depending on the length of illegal stay and outcome of a decision about if the person's U.S. family would feel extreme hardship if s/eh had to leave the U.S.
