Legal Question in Immigration Law in California
want to marry a Korean
Hi, I am an American Citizen born raised and living in US. I am involved with a Korean man who had work visa expire and I was wondering what is the best way for me to marry him within a year. What do we need to do to get this legal and get him to be legal resident here in the US and will he have to go back to Korea if he is here as an illegal now and wait for the papers to be final before we can live together as man and wife here in the US? I read something about me having to beable to support him but what if I can't I am having troubles supporting my own family due to divorce Iam on Gov aid and if we lived together I could get off Gov aid and we could help each other with finances and we could support my kids, him and I as a couple and family. He is trying to have his boss renew his work permit he is currently employed here. I would hate it if he had to leave I love him too much for him to have to leave and wait a few yaers for him to come back. Thank You for any advise you may have to offer.

Re: want to marry a Korean
You can marry him and file for his permanent residency application so that he does not need to leave the US. In fact, it would be cheaper and faster to do it this way than having him going back to Korea.
You can have a co-sponsor to file the affidavit of support. There are also some other ways to fulfill the affidavit of support requirements. If you need our help with this process, please send me an email.

If you marry him, he will be able to apply for permanent residence ("green card") in the U.S. assuming that he entered the U.S. with a work visa or a tourist visa.
