Legal Question in Immigration Law in California
Marrying a U.S. citizen who does not have income or asset
I am on f1 student status & plan to marry a US citizen. Here's the situation: I have no income and asset since I'm only an f1 student, and my future spouse owns no income or asset since she filed bankcruptcy before. But her brother is quite wealthy probably making between 100K-200K a year as a surgeon. He will be the one sponsoring us. I would like to know whether to file I-864 or I-864(A) or both? And who needs to file it? The sponsor(brother)?Thank you&look forward for the reply

Your spouse and her brother both needs to give affidavit of support.
