Legal Question in Immigration Law in California

Marrying a US Citizen

I am currently doing Optional Practical Training as part of my F1 Student Visa. I am planning on marrying my American girlfriend. We will be moving in together on 06/01 but I have heard that it can take 3 months for the request to be able to work to be accepted. My OPT runs out on 06/30 and am worried about losing my job. Is it possible for us to get married and file the adjustment of status before we move in together or do we have to wait for us to have a common residence?

Re: Marrying a US Citizen

Because you have OPT, I'm assuming you entered the U.S. inspected with a temporary visa (tourist, student). If that's the case, then even if you are out of status (visa expired), you can adjust your status if you marry a U.S. Citizen in the U.S.

Re: Marrying a US Citizen

You may file now and update your change of residence once the adjustment is filed and the first USCIS notice of receipt is delivered to you. Make sure you have all of the supporting evidence of a good-faith marriage however, as well as plenty of records once you move in together.
