As long as the foreign born spouse does not have a criminal record, the fact that the U.S. petitioner has a criminal record should not hinder the greencard process. However, the U.S. petitioner should be working, in order to be able to complete the affidavit of support. Otherwise, you will need a coo-sponsor for the financial support portion of the case.
