Legal Question in Immigration Law in California

Naturalization Certificate

When immigrating to the US, my father gave an incorrect month and date for my birthdate, I've finally been able to receive a birth certificate from the country I was born in, how do I go about correcting my birthdate on my certificate, so I can change other items (ie. passport, driver's license, etc.) I have no idea what type of lawyer can help me with this as well?

Re: Naturalization Certificate

An immigration lawyer can assist in making this rather unusual application. A lawyer could be sure the case is not ignored and is timely handled. Explanation as to how you immigrated with a birth date which is not your own would have to be reasonably explained as part of that application, with proof of some sort (which is not as difficult as you might think). I have experience working with situations such as this and understand the issues well. The government shouldn't open your entire case to look for other inconsistences, but they might if this is not handled properly.

Inconsistencies sometimes spell fraud to the government and innocent or convenience errors that are not relevant to the merits of a case should not be used as a reason for the government to go on a fishing expedition in effort to revoke a person's naturalization. I don't mean to alarm you, but unless you're counseled and the facts are clearly presented, you might be walking into a trap, by yourself!

Re: Naturalization Certificate

You really should consult an Immigration Attorney. This matter is complex and you should not try to do it yourself so you should get an attorney to discuss your options. If you are located in Southern California, you can email me your contact info, so we can discuss your particular situation. There is no charge for consultation
