Legal Question in Immigration Law in California

I am on OPT and working on EAD. My employer is filing for H1B (Part time). My wife is living with me as dependent and her current status is F2. Should I be filing for her H4 along with my H1B or can I wait until my H1B approval comes through and then file for H4 (adjustment of status)?

Hi,

Yes, it is recommended that H4 be filed along with the H1B. When your H1B is approved granting you change of status, your wife will no longer hold F2 status.
