petition I 130 for Parent with unlawful presence.
Hi i just turned 21. My mother has overstayed her visa since 2001 and is an alien with unlawful presence. Can I still petition a green card for her? Does she need to leave the country for this to work? Should I just file the petition as I would normally, filling out Q14 on I 130 with her i-94 status as ''expired''?
Do i have to hire an attorney for this process? If so, any SF bay area lawyers that can help?

Unlawful presence (UP) is only a problem if your mother departs the US. If you are a US Citizen, you can file for her adjustment of status in the US without her leaving and the period of UP is meaningless.

If you're a U.S. citizen then yes you can and no she doesn't have to leave. Some people need assistance and others don't. You can petition your mother, but she may have to leave the country to get a green card, unless she has an immigrant petition that was previously filed for her before April 30, 2001. However, you should know that leaving the U.S. triggers a 10-year bar where a person overstays for 1 year or more.
