Do I Qualify For Green Card?

Hello, and thanks for reading my post.

I came to the US from Canada in 1992 on an H-1 Visa issued for three years. In

that time I met and married a citizen of the US and have been married 10 years

however we are currently in the process of a divorce. Throughout those years I

never applied for a Green Card or Citizenship. I own a home, a business and

have filed tax returns regularly. This coming October I am planning to leave the

country and may be gone for 1 year or longer. Until now, I have never left the

country for any reason. What are my chances of a.) getting a Green Card and b.)

obtaining one prior to leaving or receiving permission to leave while the

documents are being processed?

It seems you are unlawfully present in the US for a long time. Your wife can file for your green card if there is no divorce. But the fact you are having a divorce make this option unavailable to you.
