Legal Question in Immigration Law in California

I have a question about me because i want to know if I could adjust here in the United States because my wife is a u.s. citizen and my dad he filed for adjustment of status back in the late 80's under the section 245A of the immigration and Nationality Act we were very young back then and we were mentioned on the application paperwork I was wondering if there was a possibility that i could adjust my status through that and my citizen wife so that i don't have to go out of the country. Please help me I don't want to have to go out.

If you are protected under 245 (i), you might be able to file an adjustment of status application through your USC husband's petition. We suggest you to consult with an immigration attorney.

Whether you can adjust status in the country will depend on if you entered the country with a visa and with inspection. If you did not enter inspection, you must be 245i. To be 245i a petition must have been filed on your behalf before April 30, 2001. You may be 245i eligible based on your father's petition, but you should have a full consultation with an immigration attorney to determine what your options are. If you would like to discuss this matter further, please feel free to contact me at 415-273-9123 or [email protected].
