Legal Question in Immigration Law in California
Hello, my question is about my girlfriend. She is from Central America. She came to the US illegally. She was then caught and held by immigration. Her sister and brother in law paid a lawyer to be able to work something out for her. They ended up paying a fine and she was released, but could only stay for an additional 2 months before she had to go back. After the 2 months passed she did not return. Now she has been here for more then 5 years. We met, fell in love, and now I want to propose to her. I wanted to know if there is a chance of her becoming a resident if I marry her so that she is no longer illegal? What steps would have to be taken? If there is no way possible, what if she goes back? Could I file for a fianc� visa then? Any help in my situation would greatly help. Thanks.

There is but she may have a bar for an additional 5 years and you may need a waiver for her. Consult with an immigration lawyer.
