Questions on New Laws Affecting B-2 Tourists

Hello all. My girlfriend has been visiting Los Angeles since November 2001 on a B-2 tourist Visa. She is leaving the country prior to the expiration of her six month Visa. She bought a plane ticket to return to the U.S. in hopes of visiting for pleasure / vacations for another six months.

The INS introduced new laws on 4/8/02 to go into effect in 30 days which limit the amount of time that a B-2 holder can visit the U.S. to 30 days. Is the new 30-day Visa automatic? Is it subject to the discretion of the INS official at the airport?

What steps can we take to increase the amount of time granted on the B-2? What can make our story more compelling to the INS officers? Can an I-134 stating that she will be staying with me at no cost and that I will be providing financial support help?

Those are not new laws but new INS regulations. The 30-day is not automatic but you need a compelling story for why she needs more time to visit for pleasure. And yes, it is up to the discretion of the airport inspector. Pretty tough.
