Legal Question in Immigration Law in California
R-2 derrivative?
I'man nonimmigrant religious worker (R1). I filed I-360 last year and received an aproval notice last 2 weeks ago. I'm planning to go home using Advance Parole and marry my fiancee there (my country).
Can she get an R-2 derivative after our marriage so that she can live with me here?
What's the estimated time processing time for getting an R-2?
Thanks

Re: R-2 derrivative?
Yes, the law provides for your spouse to receive derivative R-2 status when accompanying or following to join you.
Processing time at the US consulate in your country would be about the same as how long it took for you to get the R-1 originally.
