Re-entry permit for Temporary Worker (R visa)

I am currently on a Temporary Worker Visa, as a Religious worker (R-1). I would like to travel abroad during my vacation, but I don't know if my status allows me to do that, or not.

Am I eligible to get a re-entry permit and how long does it usually take to get one? What are the procedures?

You do not need a reentry permit -- you need a valid R-1 visa, which you can only apply for at a US consulate abroad. Please contact me at [email protected] if you require help with the R-1 visa application.

If you do not have an R-1 visa in your passport, you may obtain on through the consular post at your home country. Many consular posts have web sites with useful information. If you would like to review general requirements and procedures, you can go to the U.S. State Department's web site and search for the consulate or embassy for your home country. The web address is: http://travel.state.gov/links.html.

Of course, you may try to obtain a visa on your own. However, the assistance of an attorney should help reduce the anxiety of dealing with a governmental agency as well as identify any issues that may jeopardize the approval of your application.

You can travel abroad and come back on R-1 status. However, be prepared to show at the port of return your valid unexpired passport, the unexpired R-1 visa in your passport, the original I-94 when you first came to the US on the R-1, and proof of continuing employment with your religious organization, such as a letter.

Re-entry permits are for green card holders to use to re-enter the U.S. after travel of one year or more abroad. The permits generally are valid for two years from the date of issuance.

In your case, as mentioned, you need to have a valid R-1. You should be aware that travel abroad never guarantees you entrance back in the U.S. You will still be subject to the inspection process at the port of entry.
