Legal Question in Immigration Law in California

Relatives Green-Card

Hi Dear Sir/Madam,

I have applied for my daughter's green-card when I became a U.S. Citizen last year. My daughter is married and has 3 children, her son is 21 and 2 daughters 8 and 18, they all live in Iran now. Recently my daughter and her husband could get a U.S. visa to come here but did not apply for their children. Is there any way when they come here to visit me they could speed-up their green-card process through an attorney? If yes, how much it will cost them.

Thank you

Re: Relatives Green-Card

If you applied for your daughter's green card only last year when you became a US citizen, then your daughter and her family have more than 3 years to wait since your daughter is in a category that is currently processing petitions filed in May 1996. Until then she must wait since there are no immigrant visa number available for people who were petitioned in 1999. That is a matter of law and not a matter of processing so an attorney like myself can't speed it up. Maybe if I get a Congressman or Senator involved, but that's unlikely.

When the priority number on your daughter's petition is current (again, 3 years or so), then her husband and the kids under 21 can accompany her to the US with the immigrant visas. It's already too late for the son, and it will probably be too late for the 18-year old daughter by then. Their parents will have to petition for them separately.

Your question is a little confusing but when you stated that your daughter and her husband recently could get a "U.S. visa," you must have meant a tourist visa. Why didn't they apply for the children under the same tourist visa?
