Legal Question in Immigration Law in California

Can I return US safely during adjustment of my immigration status

I married to a US citizen 3+ yrs ago. I filed to change my status from previous working visa to american citizen about 3 yrs ago. We had one time interview with a INS officer in 2002. She asked us to supply more information. After we submited those information, we haven't heard any information from INS. No further interview.

My husband and I have a son about 14 months. We really want to bring my son to see his grandparent(my parents)living outside of US since my parents haven't seen him yet, plus more than 70yrs old.

My question: if I go to INS and get parol permission, I will be safe to return US since I don't have status ? Thanks.

As long as you are admissible, there should not be a problem.

Hi,

If you are after the interview but without a stamp in your passport, you could travel with an advance parole. But if you had an interview in 2002, you should have received your green card already. You will need to hire an attorney to inquire on your case and find out why is it taking so long to issue the green card for you.

Hope this helps,
