Legal Question in Immigration Law in California

Revoking Green Card

I have a mother-in-law who recently

got her green card through my

husband and me. After living here for

about 5 months, she went back to

China. She now wants to come back

but we want her to stay over there.

We are both her sponsors and I was

wondering if we can take ourselves

off as the affidavit? Is there any

thing we can do to stop her from

coming back?

Re: Revoking Green Card

Once she has received her green card, you cannot revoke it. You cannot revoke the Affidavit of Support. That is a contract you entered into with the U.S. Government.

Re: Revoking Green Card

My question is why did you bother to sponsor her for her green card -- she could have easily come to visit instead. Sorry I can't tell you how to handle this situation, but you are on the affidavit until one of several things happens: either she loses her residency status, or she dies.
