Legal Question in Immigration Law in California
Hi there
I was arrested in Oct 2008 (charges receiving stolen property, misdemeanor and identity theft, felony) later the case was dismissed
I was told by criminal attorney that the only thing that appears on my history is the arrest record for the above charges and the dismissal as I was never convicted or plead guilty.
I am planning to go outside the country for getting my visa stampped. I am concerned on how this arrest record will affect my visa interview (again the case is dismissed because of no evidence)
Thanks

Your arrest record might show up when you apply for a nonimmigrant visa. Even you did not get convicted, you might need to explain what happened in the past.
We suggest you to consult with an immigration attorney.

A review of your record is necessary to confirm just what happened. If this is not done, you could have problems getting the visa issued or returning to the U.S. It would behoove you to handle this in advance of any travel outside the U.S.
