Legal Question in Immigration Law in California

TN visa

Dear Sir/Madam,

I would like to inquire if a person with TN visa from Mexico can join and own a business here in the US while still maintaining to work for the company he was sponsored with. I am checking if my friend can join our business and be an Independent Business Owner (IBO) more like owning his own business. This internet business is similar with network marketing. He will be still working with the company he was sponsored on but he will just do this business on the side. Would this be legal? We wanted to make sure this is ok with the US Immigration before having him sign up and join the business. His visa states

Visa: R

Type/Class: TN

I would also like to check if this is also possible for H1 visa holders too.

Technically H1b visa holders and any other non-immigrant visa holders are only allowed to work for sponsoring organization only. But there are ways to get around that problem legally....
