Legal Question in Immigration Law in California
tourist visa
my husbands niece is here on a tourist visa from the uk. does she have to leave and come back in order to change her visa to student since she is going to the uv to get her masters degree. is there a way that I can sponser her to stay or get a green card.

Re: tourist visa
It is possible to change her nonimmigrant status to student without having to leave the U.S.
Also, you cannot file a family-based petition for her, you can only file for immediate relatives (spouse, parents, and children).
