Legal Question in Immigration Law in California

If someone came to the u.s.a and was told that they were not allowed in the country for five year but they still came and here husband is a citizen he is trying to put in papers for here is she going to have a punishment

I think you mean the 3 year of 10 year bars.

In any case, it is a violation of federal law and she will most probably be deported after the submission of any immigration petitions. She could even be sentenced to prison time for violation of the immigration laws before being deported.

There are waivers available which should be submitted with the petition package. The person could qualitfy for various waivers depending on the circumstances.

I recommend that they both gather all the documents and information about her immigration history that they have and sit down with an immigration lawyer to learn their options.
