Legal Question in Immigration Law in California

Do Visa applications of different classe conflict?

My wife is in the states and she holds a green card and she would be applying for a GC for me as her husband. If she applies for that, will I be able to apply for ANY OTHER type of visa like visit or buiness during the same time? If no, is there any chance of me visiting her while she is delivering our baby while I am still in queue for the GC?

Re: Do Visa applications of different classe conflict?

Yes, it would affect most nonimmigrant visa classes. You're supposed to disclose to the US consulate in the visa application that you have been petitioned by your wife for an immigrant visa (equivalent to a green card). Think about it, nonimmigrant visa classes are temporary while an immigrant visa is permanent. There is a conflict. Even a tourist visa may be denied.

If you qualify for an H or L visa, then it's OK to also be the beneficiary of an I-130 leading to an immigrant visa. In the meantime, get your wife to become a US citizen as soon as possible.
