Legal Question in Immigration Law in California

Should i wait any longer? Or it is time for a response...

i had my aos interview a few months

ago and the officer requested

additional documentation which i

mailed right away. It's been almost 3

months since that and still have no

answer.

Everything happened because I came

as f1 and i didn't enrolled due to

problems that arised once i came.

i am married to usc and my i-130 is

been approved already.

If you want to follow up with your case, you can make an iinfopass appointment to inquire your case. However, you might have a student visa abuse issue.

Please contact our office for further discussion or email me at [email protected].

Dear Inquirer:

You generally should allow 90 days for a response, depending on what documentation the USCIS requested. If you have submitted all required documentation and believe the USCIS is delaying a decision beyond a reasonable time, you may wish to consider filing a Mandamus action in US District Court to compel the USCIS to complete your case.

Please see www.hanlonlawgroup.com for more information or email [email protected] if you would like to schedule an appointment for a confidential consultation.

If there are no further issues in your case, you should be approved. What information was requested? The fact you didn't start or later attend school should not be an issue if you can prove that things changed after you arrived. If you intended to come to the U.S. as a student without studying, it's possible that they requested you file an I-601 waiver. In that case, you absolutely should be represented by counsel. Either way, I'd do an Infopass to check status, but wouldn't rush a decision if you filed an I-601. It's very important a lawyer review that application - a really good lawyer because that form involves discretion and if not prepared properly and very well documented, the case won't be approved, but with hard working counsel, based on your facts, you should be approved.
