Legal Question in Immigration Law in California

Can I wait in the US?

I have 2 questions:

-I am here on a F1 visa and plan on marrying my american fiance on May 31st. Is it possible to send the I 130 already before that or not? I heard it can take some time before I get my permit.

-Second, my F 1 visa expires June 6th, can I stay in the country while waiting for the government to look over my I 130 forms?

Re: Can I wait in the US?

You'll want to apply for an adjustment of status which involves filing the I-130 in conjunction with the I-485 and other application forms at the same time.

Once filed, you may remain in the U.S. while your application is processed.
