Legal Question in Immigration Law in California
Wife had her wallet stolen with her conditional status permanent residence card in it. Her conditional status expires March 31, 2011. Her wallet was stolen December 13, 2010. She was told on the phone by a representive of US immigration she had to file an I-90 form pay the fee of $450 even though we will be filing a form I-751 on Jan. 1, 2011 and be paying $590 when filing that form. This seems outrageous to me. What's the chance of us coming to grief if she just waits and files the I-751 on January 1, 2011. The poor dear is threatening suicide because of these beaureacratic assaninities. We just recieved notice in the mail yesterday of the requirement to file an I-951.

One cannot say exactly what USCIS will do. You need to file your I-751 now in any case, and as long as you have other proof of her status (passport etc.) you may get by, or they may make you file for a replacement.
