Hello:

Has he had his criminal trial or has he been found guilty of domestic violence? A person who is in jail for a conviction of domestic violence can be deportable. However, an automatic deportation does not happen instantly. He should be given an immigration court date, and will have an opportunity to present to the judge evidence (if any) that he qualifies to stay in the U.S. legally. He may qualify for certain applications if he is married to a U.S. citizen/legal resident or has other relatives or applications that "qualify" him to apply for legal status.
