Will undocumented girlfriend be able to work and not be deported if we marry
I am recently divorced. Incidentally my first wife was not a citizen and obtained citizenship through our marrige. I have been dating a japanese woman for 3 years part of which was during my marrige (while separated). 1 year and a half ago we let my girlfriends f1 student visa expire and she became undocumented. We have since had a child together and would like to marry but she is afraid she will be deported and we wil be separated. Is this possible if not can we get married even though she is ''illegal'' right now, and seek at least a temporary or permanent resident status and can she work, and how long is the process generaly?

Answers:
- Yes, you can we get married even though she is ''illegal'' right now.
- You can apply for permanent resident status - -- She will be entitled to work after she receives a temporary work permit.
- The process lasts approximately 11 months to obtain her permanent resident card ("Green Card").

I know you're in San Diego, but the process is the same. Our offices are handling these cases from initial filing of the paperworks to getting the green card at the interview in about four months.
