Withdrawal of I-485 application

Hi. I married a woman from Peru in 9/04. The marriage is going sour. She currently has her SSN and work permit and we are waiting the green card interview. I am seriously contemplating a divorce.

What would happen if I withdraw the green card application? Will she need to leave US immediately? She does not have degree from a US university. Would I be liable for alimony? Please let me know.

If you divorce her and withdrew the green card application, she will be denied the greencard and unless she has other temporary immigrant status, she will have to leave the US.

Whether you need to pay alimony depends on state law and your specific situation. Please consult a local family law attorney.
