Legal Question in Immigration Law in California

I am working for a non-profit organization in California on H-1 visa. Due to lack of funding, the organization has not been paying my salary regularly and I am owed at least 5 months of salary since Feb 2009. Now I am hearing that that organization may file for bankruptcy.

What options do I have to get paid my salary? What are the avenues that I can pursue so that I get some money that is owed to me?

That's not a matter of immigration law, but of labor and employment law. I could provide you a referral if you contact me directly. The good news is that if you can land a new job, you can port to a new H-1B employer even though you've not been maintaining your status. You could be viewed as maintaining status as an employee on regular unpaid leave of absence, though that doesn't sound like what happened.
