working under the table & getting paid before you leave the job.

immigrant being sponsered bt not legal to work, working under the table and now has left the job and decided to take the pay he is owed from the weekly sales out of the register, but there is a reaining balance paid due to the immigrant of 500 and now the owner of th co. want to file grand theft and inform immigrantion, what to do? the immigrant was also married on mothers day 2002.

Well, that sounds like theft to me. He shouldn't have taken the money out of the register without permission even if he thought the money was owed him.

Before he worries about the immigration situation, he needs to fight the criminal battle. If charges are filed, he needs to get a criminal defense attorney to keep him out of jail. Maybe the attorney can get the charge reduced to petty theft, which usually, the immigration authorities are not interested in going after. If he does end up going to jail, depending on the severity of the charge, he might be taken into custody by the INS after serving time. He needs to consult an immigration attorney at that time.
