Legal Question in Immigration Law in California

My name is Yessica, I entered the United States from Mexico when I was 9 years old. I came with no passport or any kind of permit. I have 2 daughters they were born here in U.S. My husband is American Citizen I attend College and have no criminal record. I was wondering if there's any way I could get papers or any law that could help with immigration status.

If you have 245 (i) protection and your husband can petition your green card. Otherwise, you will need to apply for green card in the US Consulate in Mexico. You also need an approved I-601 waiver for the green card.

If one of your parents filed for you or someone filed for them when you were under 21, then you could be a derivative of a petition through them and qualify for 245(i) and process for the green card in the U.S. If you don't qualify, then you'd have to depart and be interviewed at Ciudad Juarez with a waiver showing extreme hardship to your husband. Approval of these waivers currently is not predictable, however, a lot is based on the facts that show hardship (apart from the obvious hardship of being separated).
